Frequently Asked Questions
Answers to common questions about this service
How long does trademark registration take in India?
The full trademark registration process typically takes 18–24 months in India. However, you can start using the ™ symbol immediately upon filing. If no objections are raised, registration may be faster. An expedited examination (for an additional fee) can speed up the examination stage significantly.
What is a trademark class, and which one do I need?
Trademarks are registered in specific classes (1–45) based on the goods or services they cover. Classes 1–34 cover goods; 35–45 cover services. For example, clothing is Class 25, software is Class 42, restaurants are Class 43. Choosing the wrong class means your mark may not protect you in your actual business area.
My trademark application received an objection. What now?
Examination objections are common and do not mean rejection. You have 30 days to file a reply, and if needed, a hearing date is set. Our team prepares detailed, citation-backed replies that address examiner concerns effectively.
Can two businesses have the same name in different industries?
Generally yes, if they operate in different trademark classes and there's no likelihood of confusion. However, well-known marks (like global brands) enjoy cross-class protection.
I've been using my brand name for 5 years without registration. Am I protected?
You may have common law rights based on prior use, but these are harder to enforce and geographically limited. Formal registration gives you nationwide exclusive rights and a much stronger legal position. File before someone else does — there's no grace period.
Can I trademark a product name, tagline, or packaging color?
Yes. Trademarks can protect names, logos, taglines (word marks), shapes (3D marks), sounds, and even specific colors if they are distinctive and associated with your brand.
What is the government fee for trademark registration?
The government filing fee is ₹9,000 per class for individuals, startups, and small enterprises. MSME-registered businesses and individuals qualify for a reduced fee of ₹4,500 per class. Our professional fees are charged separately and quoted upfront.
Does a registered trademark in India protect me internationally?
A registered Indian trademark gives protection only in India. For international protection, you can file under the Madrid Protocol — a single application covering multiple countries. We advise on international trademark strategy based on your target markets.
